Read the record

In the June 2 message quoted in Schwaab’s June 3 reply, co-presidents Rutzick and McGuire say STB lacks Board permission to lead or fund an appeal. They offer continued letter encouragement and say Abe will speak as an individual. Schwaab challenges that response as dropping out. In the earlier chain, Abe explains that the Commission issues conditions and urges timely appeal paperwork.

What it establishes

Important limit on treating environmental participants as one unified campaign or attributing institutional consent.

Limits and context

The message does not establish refusal of all support or provide the Board’s full decision record. The participants’ differing procedural accounts are not legal determinations.
